The government of Argentina will appeal to the Supreme Court the judicial decision made on Tuesday by an appeals court in the country that declared the “constitutional disability” of the labor reform included by the president Javier Milei in the decree of necessity and urgency that he signed in December.
“We will appeal to each of the necessary instances and that (the Supreme Court) will be one of them.“said this Wednesday the presidential spokesperson, Manuel Adorni, in his daily press conference at the Casa Rosada (seat of Government).
The spokesperson assured that the Government of Milei is convinced that his reform “It is essential to create jobs, for companies to hire and to have a much more friendly labor market for both parties.”.
The National Chamber of Labor Appeals declared “invalids” the articles referring to labor issues within the decree of necessity and urgency (DNU) that Milei signed on December 20, ten days after assuming the Presidency of the South American country.
In the ruling, to which EFE had access, the court considered that these articles are contrary to the provisions of the national Constitution of Argentina regarding the powers of the Executive to issue decrees.
In any case, the court clarified that the articles on labor matters will enjoy formal validity in the event that the Argentine Parliament ratifies them within the period of the current extraordinary sessions, “or its validity will cease by operation of law otherwise”.
The decision of the Chamber gives rise to an appeal for protection against the reform presented by the General Confederation of Labor (CGT), the largest labor union in the country, which called a half-day general strike on January 24 and whose leaders are mainly active in opposition Peronism.
In its labor chapter, the DNU includes changes in labor trials, the extension of trial periods in companies and the reduction of pregnancy leaves, among other measures.
It also includes the reduction of contributions and retirement contributions, compensation and fines for poor registration of workers.
