The US Department of Justice filed a lawsuit this Wednesday against the state of Texas to try to knock down a new one immigration law that makes the irregular entry of people from Mexico.
“Because SB4 (the Texas rule) is subject to federal law and violates the United States Constitution, the Department of Justice seeks a declaration that SB4 is invalid and an order preliminarily and permanently prohibiting the state from enforcing it.” ”the office said in a statement.
The US Government already warned last week that it would sue the state, governed by Republicans, if it did not revoke the rule in question before today. The immigration law was approved in mid-November by the state Legislature and received the approval of the governor, Greg Abbott, in mid-December.
The Texas law, considered by experts to be one of the strictest anti-immigrant laws in American history, makes it a misdemeanor for a foreigner to “enter or attempt to enter the state from a foreign nation” irregularly.
The offense becomes a serious crime, punishable by up to 20 years in prison, if the offender is a repeat offender.
“Texas cannot ignore the Constitution of USA and the jurisprudence of the Supreme Court”Prosecutor Brian Boynton, head of the civil division of the Department of Justice, said in the statement.
Yesterday, US authorities already submitted a request to the Supreme Court to allow border patrol agents to cut the barbed wire installed by Texas on the southern border to try to reduce illegal immigration.
The wire is part of a series of measures against illegal immigration by the Texas governor, known as ‘Operation Lone Star’, and which also include the installation of a floating barrier of buoys over the Rio Grande River or the massive sending of migrants in buses to cities run by Democrats.
So far this year, US authorities have recorded more than 2 million ‘encounters’ with migrants on the southern border, most of them arrests of people who attempted to cross irregularly.
