Michigan court rejects appeal to prevent Trump from being a candidate in 2024

The supreme court of Michigan, USArejected on Wednesday an appeal that asked to disqualify the former president donald trump in that state’s primary elections in 2024 for his role in the invasion of the Capitol three years ago.

This is the latest in a series of legal challenges filed in several states across the country to prevent Trump from appearing on next year’s primary ballots for his efforts to reverse the loss he suffered to Joe Biden in 2020 and the riots in Washington. in January 2021.

These appeals are based on the 14th Amendment to the US Constitution, which says that officials who swear to support Magna Carta can be barred from holding future office if it is proven “participation in an insurrection.”

Michigan’s highest court decided in a brief ruling that “I was not convinced that the questions presented should be answered by that court.”

Lower Michigan courts had dismissed the case on procedural grounds early in the process, which was upheld on appeal. This means that the question of whether or not Trump participated in the insurrection was never addressed.

Trump, the Republicans’ big favorite for 2024, celebrated Michigan’s decision and dismissed attempts to disqualify him from the race as “a pathetic maneuver to rig the election”.

This Wednesday’s decision contradicts the recent ruling by the Colorado State Supreme Court, which ordered Trump to be excluded from the primary ballot for his role in the riots carried out by his supporters.

His detractors maintain that the former president incited with previous speeches to prevent Biden’s certification as president.

The Colorado court froze its ruling until Jan. 4 in anticipation of an expected appeal by Trump’s lawyers to the U.S. Supreme Court.

The Michigan lawsuit was filed in September by Free Speech For People, a democracy advocacy group that also unsuccessfully filed another case against Trump in the state of Minnesota and another in the state of Oregon.

More than 1,100 people were charged for the January 6 attack on the legislative headquarters, which managed to delay Biden’s certification for several hours, leaving various damages and a dead police officer, among others.
