A court of appeals USA on Monday dismissed a compensation for infringement of rights for US$ 2.18 billion obtained by the owner of the patent VLSI Technology against Intel, annulling one of the most important verdicts in the history of the industry in the North American country.
The US Court of Appeals for the Federal Circuit overturned the 2021 jury verdict that Intel Corp infringed one VLSI patent and sent the case back to Texas for a new trial to determine how much the company owes for infringing a second VLSI patent.
Representatives for Intel and VLSI did not immediately respond to requests for comment on the decision.
The VLSI patent holding company is owned by investment funds managed by Fortress Investment Group. VLSI has sued Intel in several US courts, accusing it of infringing several patents covering semiconductor technology.
A Waco, Texas, jury awarded VLSI $2.18 billion in the first trial of the dispute. The jury found that Intel’s microprocessor technology infringed patents that VLSI had acquired from Dutch chipmaker NXP. Semiconductors.
Intel overturned VLSI’s claim for more than $3 billion in damages in another jury trial in waco in late 2021. Another jury in Austin, Texas, said last year that VLSI was entitled to nearly $949 million from Intel in a third patent case.
The companies later agreed to dismiss another potential multimillion-dollar case in Delaware. Another trial is scheduled to begin in Northern California in 2024.
