The high court resolved “to deny the benefit of the guarantee of non-extradition” for “The Doctor” by assuring that, apparently, he is part of a drug trafficking gang that sends cocaine to the United States, for which it is required by the Court for the Southern District of Florida.

The JEP concluded, “after a comprehensive probative analysis,” that it is “reasonable to affirm that the behavior for which Mr. Castro Chillambo is incriminated abroad is one of permanent execution, so that, in this case, it took place between March of 2017 and April 2018, a circumstance that does not satisfy the temporal factor of the conduct, insofar as it exceeds the armed conflict and the process of laying down arms. “

Precisely, the ex-combatant had asked the JEP Review Section on January 29, 2019 to assume his extradition process as he was ex-combatant of the FARC and under the argument that the crimes for which he was requested were committed when he was in The guerrilla.

According to the court, “The Doctor” was part of the Daniel Aldana Mobile Column of the FARC and was commander of the militia of that group that operated in the municipality of Tumaco., one of the most turbulent in the southwest of the country and which has the second most important port of Colombia in the Pacific.
