Chile begins to collect the debts of parents who owe alimony to their children

A new law of Alimony entered into force this Saturday in Chili to, through State bodies, collect resources from parents who owe the monthly payment to their children and thus force them to comply with their obligations.

“Is today! Our law on Parental Responsibility and Effective Payment of Child Support Pensions enters into force. A policy for the majority of homes in Chile, which are run by women”published the Minister for Women, Antonia Orellana, in their networks.

The norm is applied six months after the start-up of a debtor registry, on November 18, which according to Government data, In half a year of operation, it has registered 80,074, of which 2,374 are women (2.96%) and 77,700 men (97.04%), with a total debt that exceeds 90,000 million pesos (about 112.6 million dollars at today’s exchange rate).

Some figures that account for the seriousness of the problem and that, moreover, do not include those who do not appear in the records because They have not been sued in the justice systems or have not legally recognized their children.

The law establishes a special payment procedure for the collection of alimony pensions, guarantees that the collection process “It is carried out with criteria of justice and dignity” and improves access to debtors’ financial information, according to a statement released from the Presidency.

As soon as the pending payment of a single monthly payment is registered, the mother or caregiver can, as of today, request a court to order the search for the debtor’s assets through three mechanisms: the withholding of funds that you have in bank accounts, in financial and investment instruments, or in voluntary pension savings accounts.

In case of accumulating three monthly payments of Alimony (total or partial, continuous or discontinuous) and not having sufficient funds to settle the debt in the three previous accounts, the court will order the payment through the available resources of the mandatory pension contributions that in Chile manage private fund administrators (AFP ).

In the South American country, children have the right to receive alimony up to the age of 21 or up to 28when they are studying higher education, and it is obtained by the father or mother who does not have custody.
