Carbon additive. Mass inspections have begun. Fraudsters face up to 8 years in prison

The carbon allowance was a one-off benefit introduced by the government last summer as a response to the massive increase in coal prices. No wonder Poles used it so willingly and in large numbers. It turns out that not everyone did it legally.

The coal allowance was a one-time benefit of PLN 3,000. zlotys, which was due to a household heated mainly with hard coal or other carbon-derived fuels. There were no income criteria, and the allowance was also available to those who had already purchased coal. The only condition was to enter or report the heating source to the Central Register of Emissions of Buildings. Only in August last year, applications worth PLN 15 billion were submitted.

The act, according to which the coal additive was introduced, provided for checks whether it was used in an appropriate way. The authorities willingly take advantage of this possibility, and during their duration they check whether the data on the statement attached to the payment of money are consistent with those entered into the Central Register of Emissions of Buildings. All thanks to the registry that appeared . According to it, each property owner was obliged to report:

  • what heat source does your home have,
  • he also declared the size of the farm and their number at a given address.

What else was noticed during the inspection? Not just a declaration

It turned out that in a few cases fraud could have occurred. For example, according to “”, in Bydgoszcz, where 1,400 inspections were carried out, some declarations concerned vacancy, or the reported premises were not coal-fired. But that’s not all. The inspections also turned out to be an opportunity to check what ended up in the furnaces. In addition to coal, it was also other waste and garbage, for which appropriate fines were issued.

Controls can be costly for fraudsters. What penalties are they facing?

What are the penalties for people who fill in falsely? It can be from six months to eight years in prison. However, as legal adviser PaweÅ‚ Wielkanowski points out in an interview with “Rzeczpospolita”, in order to present charges, the prosecutor’s office would have to prove that such action was taken knowingly and intentionally. Therefore, it most often ends with the assumption that the applicant simply made a mistake when completing it.
