Changes in leaves in 2023 result from the EU work-life balance directive, the aim of which is to equalize women’s opportunities on the labor market and to make it easier for people with children to reconcile with family life. The project is therefore aimed at adapting Polish labor law to EU law. Originally, the changes were to be implemented by August 2, 2022, but the Polish government failed to do so. The regulations are to enter into force in the first half of 2023.

As a result of the changes, two new types of leave appear: carer’s leave and leave due to force majeure. As a result of the carer’s leave, each employee is to have an additional 5 days off a year, but it must have a specific purpose. This leave can be used, as the name suggests, for the care or support of a relative: parents or spouse. This leave will also apply to a person staying in a common household who requires significant care and support for medical reasons. Care leave is to be unpaid and granted upon request. Such an application may be submitted in paper or electronic form. The employee will be able to submit it no later than 1 day before the start of using this leave.
In the event of leave due to force majeure, the employee will be entitled to 2 days or 16 hours off per year. It can be used in the event of urgent family matters dictated by an accident or ours or a family member. In the case of this type of leave during the dismissal, the employee will be entitled to 50% of the salary. salary. Additional days off will not be counted towards holiday leave, and therefore will not reduce the holiday entitlement in a given year.
Implementation of the directive is also aimed at facilitating the use of flexible work organization or extending parental leave.
