The United Kingdom has been threatening the European Union (EU) for weeks with activating the Article 16, which would allow the unilateral suspension of some parts of the aforementioned protocol.

“Let there be no doubt that activating Article 16, in order to seek the renegotiation of the protocol, would have serious consequences”, declared the vice president of the EC for Interinstitutional Relations, Maros Sefcovic.

The vice president of the EC has described as “disappointing” the UK’s lack of flexibility to reach consensus formulas that simplify the application of that remedy.

The protocol prevents the return of a trade border between the Republic of Ireland and Northern Ireland, but creates new controls on goods traveling from Great Britain to North Ireland, a region of the United Kingdom where the rules of the Community Single Market continue to apply.

The new bureaucratic burden has led to product shortages and political tensions in Northern Ireland.

In addition, the United Kingdom now demands that the Court of Justice of the European Union not be in charge of resolving disputes about the operation of said document and proposes to replace the court with an arbitration process.

It also threatens to suspend the protocol unilaterally.
