The Peruvian Prosecutor’s Office announced that former president Pedro Castillo is accused of the alleged crime of rebellion after having broken the constitutional order.
The ex-president had ordered the dissolution of Congress, hours before a vacancy request was dealt with, however, this decision could not be made since it did not meet the requirements. Finally, Congress decided to dismiss him for moral incapacity.

Article 346 of the Peruvian Penal Code establishes that “anyone who rises up in arms to change the form of government, depose the legally constituted government or suppress or modify the constitutional regime, will be punished with a custodial sentence of not less than ten nor more than twenty years”.
The arrest procedure was carried out by the Prefecture of Lima and the respective legal recognition was arranged.
The Prosecutor’s Office can request that Castillo remain in “preventive” detention, a figure that could also affect the former chief of staff, said Marita Barreto, coordinator of the special team of prosecutors against power corruption.

The entity had already denounced Castillo in October for directing an alleged criminal organization entrenched in the Government, whose purpose was to capture, control and direct contracting processes in different levels of the State to obtain illicit profits.
