The amendment to the Code results from the requirement to implement the new EU directive work-life balance. The changes relate to transparent and predictable working conditions and the so-called parental directive. The project has been prepared since February, and its assumptions must come into force by August 2 this year. However, we already know that this will not happen.
A longer vacation? Not yet. The labor code was not amended until 2023
Although the regulations were to enter into force from tomorrow, i.e. from August 2, the amendment was delayed – “StanisÅ‚aw Szwed, deputy head of the family and social policy ministry, was to inform about a possible postponement of the date of entry of the draft act at the meeting of the Problem Team for Labor Law of the Social Dialogue Council. into force – from August 1, 2022 to January 1, 2023. ” – we read on the portal.

The reason for the postponement is the calendar. The Swedish Ministry informed that the project had passed the stage of arrangements regarding the proposed solutions and was referred for consideration by the European Affairs Committee. Now the bill has to be approved by the relevant committees, in the next stage it will have to approve the bill and only then will the Polish parliament be able to conduct work on it again.
Parental leave and childcare. Changes according to EU directives
The EU directive aims to provide equal opportunities for women on the labor market and to facilitate the reconciliation of work and family life.
Its introduction will mean important changes for parents. First, the employer will have to grant nine weeks to the mother or father of the child, and the parent who takes it will no longer be able to transfer it to a partner.
Parental leave will also be extended from 32 to 41 weeks in the case of one child, and after a multiple pregnancy, the length of parental leave will increase from 34 to 43 weeks.
Pursuant to the provisions of the EU directive, a 5-day carers leave will be due. In Poland, it could replace the current so-called childcare, which today only lasts 2 days a year. But apart from the duration of the care leave, there would also be another change, namely the extension of its entitlement to all relatives who live in the same household. For now, however, it is not known what assumptions will appear in Polish law.
Reduction of working hours or flexible hours for parents of children up to 8 years of age
Parents of children up to 8 years of age will also be given the opportunity to shorten working hours and introduce flexible working hours. In practice, this means that if the employer refuses to work remotely or to work individually, he will have to inform the employee in writing about the reasons for such refusal.
Without the consent of such an employee, it will also not be possible to commission him to work at night, delegation or overtime work. So far, such provisions only applied to parents of children up to 4 years of age.
The new regulations are also to make it possible to take leave due to force majeure. It will be due in the event of urgent family matters related to illness or accident, when the immediate presence of an employee is necessary. The leave is provided for two days or 16 hours in a calendar year, and half of the salary would be paid for each day.
