The Verge: Apple defended the right to sell smart watches from the ECG

The American company Alivecor was not able to ban the sales of the Apple Watch smart watches in the United States. It is reported by The Verge.

Earlier, Alivecor accused Apple of allegedly a patent for her ECG technology, but did not receive support in court. In early March, the US appeal in the Federal District supported the decision of the lower instance that the patents of the manufacturer of Alivecor medical devices on the ECG are actually not subject to patenting.

In 2021, Alivecor sent a complaint to the US International Trade Commission (ITC), where she stated that the American IT giant violated her patent. The ITC took the side of the plaintiff, but the patent court and the appeal collegium ruled that Alivecor patents were invalid. Thus, Tim Cook’s corporation defended the right to produce and sell smart watches with an ECG.

“We are deeply disappointed with court decisions,” said Alivecor Director Sanjay Vleti. “Apple’s teams have been working tirelessly over the years to develop the functions of health, well -being and safety in the industry, which significantly affect the life of users, and we intend to continue to follow this path,” said the representative of Apple Fred Sains in a commentary for The Verge.

In January 2024, Apple had to disable the pulsoximeter function in the new smart watches sold in the USA. The reason was a violation of the Masimo patent for sensors to determine the level of oxygen in the blood.
