The European Court of Human Rights will investigate the Pegasus scandal. Trzaskowski doubts that the 2019 elections were free

The European Court of Human Rights will hear a complaint from nine Polish politicians regarding the use of Pegasus. The complainants include Rafał Trzaskowski, Krzysztof Brejza and Małgorzata Kidawa-Błońska. They question, among other things, whether the 2019 elections can be considered free in connection with wiretapping.

“The European Court of Human Rights will examine the use of Pegasus in Poland” – informed attorney Sylwia Gregorczyk-Abram against X. The complaint was filed by Jacek Karnowski, Dorota Brejza, Krzysztof Brejza, Ryszard Brejza, Hanna Zdanowska, Zygmunt Frankiewicz, Małgorzata Kidawa-Błońska, Barbara Nowacka and Rafał Trzaskowski.

“The applicants allege, among other things, a violation of Articles 8 and 13 of the Convention, indicating that they were or there is a high probability that they could have been subjected to unauthorized and unlawful surveillance using the Pegasus software and that they did not have at their disposal any means by which they could have lodged a complaint about the surveillance in question,” reads Gregorczyk-Abram’s entry.

As the lawyer added, the politicians “also allege that, due to the use of the Pegasus software against political opponents during the election campaign, the 2019 parliamentary elections were held in conditions contrary to the right to free elections as expressed in Article 3 of Protocol No. 1 to the Convention.”

A Pegasus commission has been operating in Poland for several months. Zbigniew Ziobro, the key figure in this case, the Minister of Justice in the PiS government, has not yet been questioned. The politician once again justified his absence from the hearing. Ziobro is struggling with cancer.
