The bailiff will “come” to the debtor online. A revolution in debt enforcement

Instead of traditional letters, bailiffs will send electronic letters. This solution is supposed to be faster and cheaper. The changes will come into effect in a few days.

The National Council of Bailiffs announced that it will start implementing the e-delivery service in bailiff offices from July 1. “This is a major digital revolution, and bailiffs are the pioneers of this solution,” we read on . This step towards modernity is made in cooperation with the Ministry of Justice and Poczta Polska.

The bailiff will “come” to the debtor online

e-Delivery is nothing more than the electronic equivalent of a registered letter with acknowledgment of receipt. “Thanks to this service, public entities, citizens and companies can benefit from convenient and secure electronic deliveries. They are legally equivalent to traditional registered mail with acknowledgment of receipt,” we read on the website.

Bailiffs are to send e-mail only to recipients who are logged in to the system. In other cases, Poczta Polska will print the correspondence and deliver it by classic registered letter. Importantly, this will only work in one direction. The bailiff will be able to send electronic correspondence, but the party to the proceedings will not.

Electronic correspondence means great savings

“This means significant savings for the law firm, in addition to shortening the time needed to deliver the parcel, no need to print, pack and send letters” – the National Council of Bailiffs praises this solution. This function is not completely free because it costs PLN 5.41. However, it is cheaper than a traditional paper letter, which costs PLN 11.8 to send with acknowledgment of receipt.

– Looking at the price of a single shipment, it may seem that the savings for the debtor are not too great. However, he bears the costs not only of correspondence addressed to himself, but also of all other letters sent in his proceedings, which may be several or even several dozen – explained Marek Cichosz, treasurer of the National Council of Bailiffs, in an interview with “”. He calculated that in the scale of the entire system, savings may reach dozens and, over time, even more than PLN 100 million per year.

There are more advantages. The person against whom enforcement proceedings are pending will receive correspondence regardless of the address where he or she lives. This will help him realize he’s in trouble sooner. Moreover, all documents will be able to be packed into one file.
