Polish Ceneo wins over Google. The court issued a decision

The Polish company Ceneo submitted an application to secure claims against Google. It’s about the giant favoring its own price search engine. The court agreed to the request and banned Google from using unfair practices. For violating the ban, the company faces a fine of PLN 50,000. PLN per day.

“The court’s decision results from the application that Ceneo submitted in connection with accusing Google of using unfair competition practices,” we read in . In the letter, representatives of the Polish comparison site pointed to four types of practices that, in their opinion, Google uses to limit access to the market. The court took into account all arguments and banned the platform from favoring its own search engine at the expense of a domestic company.

In the application to secure claims, representatives of the Polish company pointed to four Google practices that were supposed to limit access to the market:

  • favoring your own Google Shopping comparison engine through a specific way of presenting search results;
  • redirection to the mentioned comparison website at the expense of Ceneo;
  • removing search results that would lead to the Polish comparison site;
  • displaying unauthorized Ceneo advertisements, aimed at collecting information about the preferences of users of this search engine.

Ceneo representatives believe that such practices were already visible in August 2023. – Despite a formal request to stop the violations, Google did not abandon these practices, which is why we were forced to pursue our rights through court proceedings – Ceneo informed “Dziennik GazetĂȘ Prawna” .

As reported by the daily, the application was the first step in the battle with Google. The second was to file the actual lawsuit on March 28. The president of the Office of Competition and Consumer Protection commented on the case and presented his arguments in the case before the court. According to him, both placing the Google price comparison site in places that are easier for users to see and displaying more visually attractive elements potentially have a negative impact on the so-called healthy competition, because people using a price comparison website will automatically choose Google.
