The tax office will receive tools that will enable it to control private persons who sell via platforms such as OLX and Allegro. Will tax offices also collect information about buyers? “I deny it,” said Finance Minister Andrzej Domañski to these speculators.

The tax office will soon receive a new whip against people who make a large number of transactions on auction portals. This week, the Council of Ministers adopted the DAC7 bill. It imposes on the operators of platforms such as Allegro and OLX the obligation to collect and transmit to the tax administration information about sellers who made transactions via these platforms. According to the announcement, the new regulations will enter into force on July 1, 2024.

The obligation to collect data was imposed not only on online e-commerce platforms, but also, among others, on means of transport rental platforms and platforms for ordering car rides. This means that it includes websites such as Booking, Otomoto, AirBnb, Booking and Booksy.

As explained by the Ministry of Finance, the tax office will receive information about sellers who made at least 30 transactions during the year or persons whose sales value exceeded EUR 2,000 in a given year.

In connection with the changes being prepared, there have also been reports in the public space that the new tools will allow the tax office not only to control sellers, but also buyers on e-commerce platforms.

– I deny it. We are only talking about online sales transactions for entities that have more than 30 such sales transactions during the year. Then the transactions will be reported, Domański explained. At the same time, he added that “this is a new obligation imposed on online platforms and is a response to the fact that a significant part of retail sales has moved online.”

– We must fight unfair competition that takes place on the Internet. There will be no surveillance of online buyers. We are talking about the obligation to report sales transactions

At the same time, Andrzej Domański reminded that the new regulations are not the idea of ​​the Polish government. The changes result directly from the EU directive, and Poland should implement them from January 1, 2023. – We are the only country that has not implemented it – he noted.
