The United States Supreme Court on Friday agreed to hear the appeal of Donald Trump to a Colorado Supreme Court ruling that would remove him from the bench presidential primaries in that state in the west of the country.
The Supreme Court, with a majority of conservative justices, including three appointed by the former president, plans to hear oral arguments in the case on February 8.
Last month, the Colorado Supreme Court banned Trump from appearing at the state’s Republican primary. for his alleged role in the January 6, 2021 attack on the Capitol by his supporters.
He invoked the 14th Amendment to the U.S. Constitution, section three of which prohibits anyone from holding public office if he or she has participated in an “insurrection or rebellion” after pledging to support and defend the Magna Carta.
The amendment, ratified in 1868 after the Civil warwas intended to attract followers of the slave confederation were elected to Congress or held federal office.
Lawyers for Trump, the front-runner for the Republican presidential candidate, have asked the US Supreme Court to overturn the ruling in Colorado.
They estimate that “if upheld, it will be the first time in United States history that the judiciary has prevented voters from casting their ballots for a major party’s leading candidate in the presidential election.”
Only Congress has this privilege, attorneys say.
Trump’s lawyers also argue that section three of the 14th Amendment does not apply to Trump as a former president, that January 6 was not an “insurrection” and that the tycoon “did not participate in any manner whatsoever in an insurrection.”
