Homophobic and transphobic slurs will be criminalized just like racist slurs in Brazil after the country’s Supreme Court ruled to classify it as a crime.
Thus, those who defame a person’s honor because of their gender or sexual orientation will be prosecuted in the same way as those who discriminate on the basis of race, color, ethnicity, religion or origin. This crime does not allow or prescribe bail.

The Brazilian Association of Lesbians, Gays, Bisexuals, Transvestites, Transsexuals and Intersexuals (ABGLT) drew attention to the case and the highest court accepted the request. Judge Edson Fachin said the ruling was a “constitutional obligation” to legally protect people from the LGBTQI+ community.
People who insult in a homophobic or transphobic way can face a prison sentence of two to five years.
