The CKE used the illustrations without the consent of the author. Translates as “task disclosure protection”

The eighth grader’s exam included a drawing created by an artist known as Itchy Feet. The Central Examination Commission did not ask for permission to use the illustration, and now explains that it did not have to. For two reasons.

The eighth grader exam has been occupied by students and parents for the last few days. It turns out, however, that one of the illustrations that illustrated the math problem may have been created in violation of copyright. The map drawn with a light line, on which two points were marked, ordering calculations, is in fact the work of an artist working under the pseudonym Itchy Feet.

Interestingly, on the CKE sheet, a fragment of the drawing appears processed – the inscriptions have been removed from it (which, by the way, is the essence of the joke that the artist wanted).

Zbyszek “Kebab” Piotrowicz from ARHN.eu asked the cartoonist directly if he knew anything about the “new life” of his illustration. “Hi. Did you receive any compensation for using your drawing on the Central Examination Board card? Just out of curiosity?” he asked. “No. No one has contacted me. Which is a bit sad because I always allow my work to be used for educational purposes. But first you have to ask,” the creator described. In a follow-up post, he said it reminded him of a situation where a student “uses Wikipedia in his essays.”

The CEC responds to the allegations

The Central Examination Board reacted immediately to the request of next.gazeta.pl for a comment. CKE explains that “in some tasks, already popular songs are used in the exam sheets”.

These works are used in the so-called fair use provided for in Art. 27 sec. 1 of the Act on Copyright and Related Rights (Journal of Laws of 2022, item 2509). The Central Examination Commission is a state budgetary unit of the education system, which does not operate for commercial purposes.

The Central Examination Board also informs why it did not contact the author of the original drawing. He says it would be against the rules. “At the same time, it should be emphasized that – in accordance with Article 9e paragraphs 1 and 2 of the Education System Act (Journal of Laws of 2022, item 2230) – the preparation, printing, storage and transport of examination materials must take place in conditions ensuring their protection against unauthorized disclosure, and persons involved in the preparation, printing, storage and transport of these materials are obliged not to disclose examination materials to unauthorized persons.

Due to the need to ensure this protection, it is not possible to consult the author of the work. Therefore, the sources of materials are always provided in the sheets, including materials used to create the graphics, if they are illustrative graphics.

The Central Examination Board also assures that it attaches great importance to the correct identification of authorship when using a work. “After the information obtained yesterday – the source in the sheet has been supplemented, the sheet available on the website now contains all information about the map’s author and the original source. We fixed the reported irregularity immediately after learning about the incomplete identification of the source” – concludes the CKE.
