Before the provision, regulations dictated that transgender athletes who wanted to compete in the female category kept their testosterone levels below the threshold of 5 nanomol/l for a year.

The athlete filed a complaint with the Court of Arbitration for Sport for this measure, but lost.

The International Olympic Committee (IOC) had asked sports federations in November 2021 to set their own criteria for transgender and intersex people in high-level competitions.
