Sellers are required to provide it almost every time they discount a given product. All this to eliminate the phenomenon of fakes when the promotional price is higher than the regular one.

UOKiK checked how the Omnibus Directive works

This obligation has been in effect for more than two weeks. At that time, he watched entrepreneurs. UOKiK checked about 40 websites from the e-commerce sector. Among them were such platforms as , Amazon, Lidl, Biedronka, Media Markt and Media Expert. Unfortunately, he noticed that not everyone complies with the new law, and some inform about prices incorrectly.

– From the beginning, we have been monitoring practices regarding the implementation of new regulations. We can already see that not all entrepreneurs have adapted to them. We observe many irregularities, especially in the field of displaying prices, including the lowest from the last 30 days before the reduction – says Tomasz Chróstny, President of UOKiK.

UOKiK noticed many irregularities

UOKiK’s reservations, which were listed in , raised such practices as:

  • Providing the current sale price and the strikethrough price without specifying what the strikethrough price is,
  • Providing the current price and the strikethrough price, with the message explaining that the strikethrough price is the lowest price of the goods, which was in force in the period of 30 days before the introduction of the reduction, is available only after expanding,
  • Using other reference values ​​when presenting discounts (crossed-out price), omitting the lowest price from 30 days before the discount,
  • Calculation of the amount of the discount (e.g. 20%, PLN 150) in relation to the last or standard price of the goods, and not the lowest price in the last 30 days,
  • Using phrases other than “the lowest price of the goods within 30 days before the discount”, i.e. “reference price”, “previous/last lowest price”, “price from 30 days before the promotion”,
  • Presenting information about the lowest price applicable in the period of 30 days before the introduction of the reduction in an illegible way: font, colors, contrast.

UOKiK announces further inspections

– Together with us, we will ensure that the law is respected for the benefit of consumers. We are starting inspections in retail chains, we have also requested explanations from about 40 entrepreneurs from the e-commerce industry, further inspections in brick-and-mortar stores are planned, announced the President of UOKiK.

However, regardless of the actions against online stores, inspections by the Trade Inspection will begin in brick-and-mortar stores. At the beginning, inspectors will inspect 6 retail chains: , Dino, Kaufland, Lidl, Netto and Żabka. In subsequent stages, inspections are also planned in other areas.
