Judge suspends elections in Emelec, whose board of directors rejects decision

The document states: “On December 13, 2021, at first, ten protection actions were presented and, later, two more, on December 20, 2021. The first ten exactly the same, only changed the name of the actor and the lawyer who signed them. The same thing happened with the last two, but they changed the font ”.

The board of the electric club questions in the text, and does not “stop drawing attention”, that all the actions “are exactly the same, that is, twelve people and twelve lawyers write exactly the same.”

Along these lines, it is detailed that “all the actions were withdrawn, except the number 09332202116716, whose actor was Mr. Juan de Dios Lozano Chapiro. This action fell before the judge of the Civil Unit, Mr. Lawyer Danny Daniel Castro Mendoza, who, despite the arguments presented by the club, decides to accept the demand for protection action and suspend the elections called for January 30, 2022 ″.

The board met on Monday to discuss the issue and rejected the constitutional judge’s decision.

The oral ruling has already been appealed, in the absence of the written sentence.

Emelec’s board of directors aims to convene an assembly of partners “in the next few days.”

“As an institution of private law, we insist, we strongly reject the decision taken by the judge Danny Daniel Castro Mendoza in flagrant violation of our legal system and we will continue to ensure the rights of our institution ”, the document concludes.

The term of the board of directors at Emelec comprises a four-year term. The current administration has been in office since the 2018 season. However, Neme has been reelected since 2012, after succeeding former president Elías Wated (resigned) in April 2011. (D)
