At this moment, the Ministry of Sports appeared. In accordance with the current law, it is up to the said state portfolio to register the appointment of the administration so that it can function legally. This did not happen. The ministry refused the registration and informed Barcelona that it had ten days to respond to several objections. The first relates to the assembly and elections: “In accordance with point c) of Article 15 of Ministerial Agreement 0389 of September 20, 2021, issued by the Ministry of Sports, please send the minutes of the General Electoral Assembly of November 1. 2023, duly signed by the president and secretary, with the corresponding list of attendees.” Alfaro Moreno issued a certificate on December 11, 2023 that there are no pending appeals.
The ministry is now seeking confirmation that Alfaro was in an extended presidential role, as his term expired on December 3 of that year. On the other hand, there is documentary evidence that on November 10, 2023, Darwin López Muñoz filed an appeal with the Electoral Court against the resolution of November 7 recognizing Antonio Alvarez and his list as the new leaders, and then on November 24, 2023, the scope of the cited source. This would mean that the certificate signed by Alfaro Moreno would be false.
The fifth remark refers to the prohibition of “registration of the active manager of another sports institution that is related to the same activity as the club. In this regard, by official letter No. SD-DAD-2020-1682 of December 4, 2020, the Directorate for Sports of the Ministry of Sports registered the directory of the professional sports club Toreros Fútbol Club, in which the president is Mr. José Luis Nogales, Mr. Francisco Javier López as treasurer and Mr. Antonio José Alvarez Henriques as the other main member.
