In Russia, collectors will face up to 10 years in prison for threats

The State Duma adopted today in the third, final reading a bill on imprisonment for up to 10 years for the use of violence or the threat of its use in the implementation of collection activities. The Criminal Code of the Russian Federation will be supplemented with a new article providing for liability for the illegal implementation of activities to return overdue debts of borrowers.

Thus, for the commission of actions aimed at repaying the debt of individuals and associated with the threat of violence or destruction, damage to property, as well as the threat of spreading or spreading knowingly false information that discredits the honor and dignity of the victim or his relatives, by a person acting on behalf of the organization – creditor or in its interests, a fine is provided from 300 thousand to 500 thousand rubles or in the amount of wages, other income of the convicted person for a period of one to three years.

In addition, forced labor for a term of up to five years, imprisonment for a term of up to five years without the right to hold certain positions or engage in certain activities for a term of up to three years may be assigned.

For similar actions committed by a group of persons by prior agreement or with the use of violence that is not dangerous to life or health, or with the destruction or damage of property, or on a large scale, the law provides for imprisonment for a term of three to seven years with a fine of in the amount of 500 thousand to 1 million rubles or in the amount of wages, other income of the convicted person for a period of two to four years or without it. Perpetrators may also be deprived of the right to hold certain positions or engage in certain activities for up to three years.

It also provides for punishment for acts committed by an organized group or with the use of violence dangerous to life or health, or on an especially large scale. In this case, the perpetrators may be imprisoned for a period of five to ten years with a fine in the amount of 1 million to 5 million rubles or in the amount of wages, other income of the convicted person for a period of three to five years, or without it. In addition, the law provides for the possibility of deprivation of the right to hold certain positions or engage in certain activities for up to three years.

The State Duma believes that the new norms will be “serious steps to restore order in the field of collection activities.”
