“I don’t see that FIFA manages to put Chile in Ecuador’s position,” says Byron Castillo’s lawyer on appeal filed by Peru

Although FIFA, on two occasions, has already issued conclusive rulings in favor of Ecuador in the Byron Castillo case, now Peru has joined Chile in presenting an appeal before the TAS Arbitration Court (for its acronym in French) because the leaders of those countries do not accept the decision.

On June 10 and September 16, FIFA ruled in the first instance and after the appeal, on the complaint filed by the National Association of Professional Football of Chile (ANFP) for alleged irregularities in the nationality of the tricolor soccer player .

This despite the fact that since January 28, 2021, Judge Ronald Guerrero Cruz, of the North 2 Criminal Judicial Unit, based in Guayaquil, declared the habeas data that Byron David Castillo Segura presented admissible and ordered, in an official letter dated January 25, February of that year, addressed to the Civil Registry of Ecuador, to register the soccer player as an Ecuadorian citizen. In other words, for all purposes, Castillo, by order of the Judiciary, is Ecuadorian.

This Friday the newspaper Tradefrom Lima, mentions that the Peruvian Football Federation (FPF) asks that the Tricolor be excluded from the Qatar 2022 World Cup and that its place be taken by the team of that country.

The newspaper mentions statements by Andrés Holguín, Byron Castillo’s lawyer, who indicated (when the claim was in the second instance in FIFA) that if Ecuador is disqualified, Peru should take its place. “I don’t see that FIFA manages to put Chile in the position of Ecuador, because Peru has to go up, which would have to go directly to the World Cup. Colombia would go to the playoffs. But should the Aussies have to play again?” sarcastically.

Australia left the Peruvian team out of the Qatar World Cup, which they beat in a penalty shootout in the only playoff game.

Both Chileans and Peruvians have submitted their appeal to the TAS, an organization that, through a statement, made public the receipt of the documents delivered by both federations.

“The appeal filed by the Peruvian Football Federation (FPF) is directed against the FEF and FIFA. The FPF requests that Ecuador be excluded from the 2022 FIFA World Cup and be replaced by Peru, who were the highest placed team in the table after Ecuador. The appeal filed by the Chilean Football Federation (FFCH) is directed against the FEF, the player Byron David Castillo Segura, and FIFA,” the letter says.

“The FFCH asks the CAS to determine that the player was not eligible in the 8 matches he played in the qualifiers, and to consider those matches lost by Ecuador, which would place Chile in fourth position in the CONMEBOL qualifiers for the FIFA World Cup Qatar 2022.
