The lawyers of the Brazilian player Daniel Alves, in custody for three months, have again filed an appeal for his provisional release, days after his new testimony before the judge investigating the alleged rape for which he was denounced by a woman in Barcelona.
The defense of the player, whose first request for release pending trial was already denied by the Court of Barcelona in February, says that Alves “can and wants to defend himself and will not flee the process”, according to a statement released on Thursday.
For her lawyers, who claim to base her request on the presentation of video evidence that confronts the complainant’s story, the “risk of flight is unthinkable” and propose the possibility of imposing a bail and the withdrawal of her two passports (Spanish and Brazilian).
Dani Alves remains in provisional detention, communicated and without bail since January 20, for a lawsuit filed for the alleged crime of sexual assault, which in Spain includes rape. A young woman accuses him of having raped her in a bathroom in the VIP area of a Barcelona nightclub at the end of December.
The possibility of escape was precisely one of the reasons that the Court of Barcelona alleged to deny his first request for freedom.
At the time, the court also did not accept other alternative measures, such as withdrawing the passport, considering that, if he traveled to Brazil, it would be very difficult to process his delivery to Spain, since Brazil does not usually extradite its citizens.
This new request, now in the Court of Instruction, comes shortly after Alves reaffirmed to the magistrate, on Monday, that he had consensual sexual relations with the complainant, in an appearance made at the request of the player himself.

In his first statement, on the day of his arrest, the player, who initially denied knowing her, changed his version several times and ended up admitting that they had consensual relations.
