This Thursday, Daniel Alves’ lawyer admitted, for the first time, that there was “consensual vaginal penetration” in the relationship between the player and the woman who accuses him of rape, at a hearing to discuss the provisional release of the Brazilian right-back, in Barcelona, ​​as reported by the newspaper The vanguard.

The player who has been held in custody since January 20 accused of sexually assaulting a 23-year-old Spanish woman. The victim’s lawyer, Ester García, was also present at the hearing.

In this way, a new version of the case appears, different from the others provided by the player. At first, Daniel Alves denied that he knew the woman who accused him. Afterwards, he revealed that they were both in the bathroom together, but that she had thrown herself on him. Finally, he admitted that there was a consensual relationship.

According to the newspaper, Daniel Alves’ lawyer stated that the young woman did not have injuries compatible with rape. He pointed out that “the medical report from the hospital that assisted the woman in the early hours of the incident did not identify vaginal lesions compatible with a non-consensual relationship”.

As soon as he was arrested, the player was taken to the Brians 1 Penitentiary Center, on the outskirts of Barcelona, ​​but was transferred to Brians 2 for security reasons. If he is convicted, the player could face a sentence of up to 15 years.

Daniel Alves was arrested on January 20 after voluntarily giving testimony to the police in Barcelona, ​​Spain, on a charge of sexual assault against a 23-year-old girl at a local nightclub, called Sutton, on December 30, 2022.

The Catalan authorities have informed that the player must remain detained until the trial of the case takes place, still without a defined date. Later on the same day as the arrest, Pumas, from Mexico, announced the termination of the 39-year-old’s contract.

The judge in the case, Maria Concepción Canton Martín, ordered Daniel Alves to be held in custody without bail, at the request of the Public Ministry. She was the one who heard all the testimonies (from the complainant, Daniel and a friend of the athlete who was present at the nightclub) and had access to the evidence presented by the young woman.

Daniel Alves denies all accusations, but has changed his version of events at least three times. The victim’s lawyer reported that Daniel did not use a condom and that his client underwent treatment to avoid sexually transmitted diseases.
