Judges Kléber Franco, Rosario Franco and Susy Panchana, members of the Santa Elena Provincial Court tribunal, accepted the habeas corpus appeal granted weeks ago to Dutch citizen Vokshi N, 55, who had a ballot of Interpol capture.

Iván Saquicela, president of the National Court of Justice (CNJ), presented the appeal against the decision issued by Érika Montiel, judge of the Multicompetent Judicial Unit of Manglaralto, for granting the ‘habeas corpus’ to the foreigner, within a process of passive extradition, without being competent.

In the court’s resolution, Judge Moriel’s action was declared null and void due to “lack of jurisdiction due to the degree and the territory in the processing of the ‘habeas corpus’ case,” it was indicated.

It was also indicated that by not notifying the president of the National Court of Justice, the jurisdictional authority that ordered the deprivation of liberty of the foreigner, he was left defenseless. The CNJ indicated that Saquicela was not notified for the hearing of habeas corpus and that the SNAI did not appear to exercise the contradiction either.

In the resolution, adopted last Friday 113, the judges asked to comply with the detention of the Dutch citizen. To do this, the Police ordered the location and immediate capture of him.

Regarding the judge’s actions, the court declared that she made an “inexcusable error”, in response to which the Judiciary Council will be notified so that the due disciplinary control can be carried out.

The court also requested that the servants of the entity in charge of the prison system (SNAI) who intervened in this case be investigated.

On April 21, the president of the CNJ, Iván Saquicela, denounced that the judge of Manglaralto (Santa Elena) granted the ‘habeas corpus’ action in favor of the European, despite “lacking jurisdiction” for his request for extradition by the Netherlands for the crime of drug trafficking.

The Dutchman had been arrested in the La Aurora de Daule parish on April 2. (I)
