After having been on vacation for fifteen days, the judge of Penitentiary Guarantees Carlos Cedeño decided to modify the habeas corpus granted last week to Júnior Roldán that allowed him to return home due to alleged health problems.
The decision made by his replacement, temporary judge Pedro Moreira, who was suspended after the controversial appeal, caused a debate about the measure. Even President Guillermo Lasso asked the Constitutional Court to define the scope of the habeas corpus and allow them to initiate ex officio investigations to sanction judges.
In this case, a police report indicating that the house of Roldán, one of the bosses of Los Choneros, does not meet the conditions was the support that Cedeño used to modify the measure and decide that Roldán could only be transferred to the Guayaquil hospital, until his health is restored, and then he must be returned to the Regional prison, where he has been since 2015 for murder.
Junior He is serving two sentences of 22 years for the crime of murder, but there are other investigations of crimes that would have been ordered by him from prison.
In addition to the report that has served as support to stop the house arrest, Judge Cedeño has indicated that in El Triunfo there is no level 3 hospital that can attend to any emergency in the event of a breakdown in the inmate’s health.
It is also highlighted that the place does not comply with security for the 20 policemen who were going to take care of it and that even the neighbors were in danger in the sector, because on Friday a car without license plates was shot on the street of Roldán’s house.
An El Triunfo police officer indicated that a man who came to visit his mother in that area got into his new car, still without license plates, and that he had been shot by men from Los Choneros. That day, alias Junior he was supposed to be transferred to his home.
Fabiola Gallardo, director of the Provincial Court of Justice, mentioned that Judge Cedeño has had police protection for him and his family since Wednesday. Also, that in the offices of the Judiciary the police presence has been reinforced.
Shortly after the Court announced the modification of the habeas corpus from Juniorthe director of the Albán Borja Judicial Unit received a call alerting of an alleged bomb in that unit, and the premises had to be evacuated.
At 12:00 there was also a bomb alert in the Court of Justice, in Quito and on October 9. There the officials were evacuated until it was ruled out that the suitcase abandoned in the place had explosives. (I)
