To know fill out a claim form and what to do with it afterwards is one of the most useful skills any citizen can have. No one is free from an unpleasant surprise in a store, with a product or a service.
A claim form is a document through which a consumer makes make a complaint relating to a good or service you have purchased. It is a resource that can only be used by the final consumer, through which you inform the Administration, extrajudicially, that you do not agree with the product or service you have received. Knowing how to present it successfully seems very easy, but sometimes there are some small obstacles that you have to know how to overcome.
In Madrid alone, a total of 26,654 files were processed in 2019 with 61.3% of mediations positive. For its part, in Barcelona there were 5,328, with 53.7% of resolutions favorable to the consumer, according to the Municipal Office of Consumer Information (OMIC) citing the Annual Report on Actions in Consumer Matters of Madrid in 2019.
The purpose of putting up a claim sheet is ask the Administration to carry out an intermediary task with the company with which you have the problem, that is, you inform the company of the facts claimed and request a solution.
What are the claim forms like?
Is about carbonless sheetsdocuments officers issued by the Autonomous Communities. By legal imperative, all those individuals or legal entities that act within the framework of a business activity aimed at the commercialization of goods or services for end users or consumers have the obligation to make the complaint sheets available to the end consumer. (Surely you now remember the signs informing of “We have claim forms” that you have seen so many times).
The leaves usually come in a small threesomebut in the Valencian Community four come together. Each tracing sheet is of a color and it is for a recipient: the provider (pink), the client (green) and the administration. The original that must be written on, which is the white one, is the one that must be presented to the competent Consumer Administration.
The sheet must be signed by both parties, but you do not need to write it at the momentbut you can do it later and ask them to sign it when you go to deliver it.
What to put on the claim sheet
The fields that must be filled in so that the claim sheet is complete are fundamentally:
1. The data of the claimant. Name, surnames, DNI, address and contact telephone number
2. The data of the company or professional to whom the claim is made. Trade name, company name, address, NIF and telephone number of the company.
3. The complete description of the fact, including date and place. It is important that you explain what happened concisely. Write in capital letters. You can add a separate document if you do not have enough space on the claim sheet.
4. What is requested: compensation, apology, new product, repair, discount, etc.
5. Documents attachments. Invoice or purchase ticket, photos, contracts, etc. which will serve as the basis for the claim.
6. Take the sheet to Consumption. The first thing you should do with the claim form is give it to the respondent and wait for their response for ten days. Then of that, if you do not have an answer, you have to present it in person or electronically in the OMIC corresponding or in the General Directorate of Consumption of your Community.
Common mistakes with claim sheets
1. If they tell you they don’t have leaves of claims, do not believe it. If they really do not have it, you can request the assistance of the local police, who will record the incident. Not having claim sheets, if the establishment is required to have them, is punishable. They also have to show a poster announcing the availability of claim forms, at least in the Community of Madrid.
2. Do not leave the copy to deliver to the administration in the hands of the defendant. Sometimes they use this trick to make it impossible to exercise the right to file the claim sheet.
3. Pay first. It is better for you to pay and then order the blade. In this way you will have proof of purchase and they will not be able to report you for non-payment.
4. Do not deliver the originals. Always keep the documents and do not give the originals to others.
