Teacher sentenced to four years in prison for hate crimes against her student, in Loja

A court in Loja considered that a teacher committed the crime of acts of hate for constantly humiliating a 5-year-old student, denying him a greeting, pointing out his shortcomings and preventing him from sharing recess with his classmates.

Part of these arguments were those that the court collected to sentence teacher Carmen T. to four years in prison.

This case was reported in an educational institution of the Sabanilla parish, in the Celica canton, in Loja, during the 2018-2019 school year.

He came to court when the minor’s family filed a complaint when the child tried to commit suicide, as recorded in the process.

The Prosecutor’s Office indicated that the boy hung himself from a beam in the kitchen of his house, but the suicide was not consummated because his grandmother arrived at that time. When the grandmother asked him why he had done it, the boy replied: “because his teacher did not want him”, according to the testimony collected by the Prosecutor’s Office.

Teacher found guilty of hate against child

The case was heard over two days of hearings. In this process, the Prosecutor’s Office presented evidence, reports, and the expertise carried out. “The investigations established the responsibility of the teacher, through the psychological tests, which demonstrated the degree of affectation in the victim; of social environment, which determined the socio-economic condition of the victim, “said the Prosecutor’s Office.

In addition to the sentence, the Court imposed on the teacher a fine of ten unified salaries of the worker in general and the payment of 800 dollars of comprehensive reparation to the victim and his family.

The teacher received the maximum sentence for this crime, increased by a third, by determining that there were aggravating circumstances.

Article 177 of the Organic Comprehensive Criminal Code (COIP) states that “the person who commits acts of physical or psychological hateful violence against one or more people because of their nationality, ethnicity, place of birth, age, sex, identity of gender or sexual orientation, cultural identity, marital status, language, religion, ideology, socioeconomic status, immigration status, disability, health status or carrying HIV, will be punished with a custodial sentence of one to three years.

In Ecuador, similar convictions have already been issued in previous years. In 2011, a mother denounced a teacher at a public school in Sauces 5, in the north of Guayaquil, for discriminating against her son, then 9 years old, with an intellectual disability.

Two years and eight months later, the Third Court of Criminal Guarantees of Guayas orally declared the teacher guilty of the hate crime against the minor, who suffers from 65% intellectual disability due to bipolar disorders.(I)
