The Moscow City Court did not confiscate 62 land plots and seven houses from relatives of an ex-FSB officer accused of particularly large-scale fraud

The Moscow City Court rejected the appeal of the Prosecutor General’s Office, which sought to confiscate 62 land plots and seven houses from relatives of former FSB officer Andrei Vasiliev, who was accused of large-scale fraud. Writes about this “Kommersant”.

At the end of January 2022, the Khoroshevsky Court of Moscow partially satisfied the claim of the Prosecutor General’s Office of the Russian Federation on the conversion of money, real estate and jewelry that were received on unconfirmed income into state revenue. The lawsuit dealt with property totaling more than 1 billion rubles, while the court ruled on the confiscation of 42 real estate objects in the amount of 174.9 million rubles.

The Moscow City Court found it justified to limit the claims of the Prosecutor General’s Office to a time frame: by decision of the court of first instance, only real estate received by the family from January 1, 2013, when the law on the obligation of civil servants and members of their families to declare large acquisitions, was subject to confiscation, until March 19, 2014 year, when the retired major Vasiliev was fired from the FSB.

The former head of the 2nd “banking” department of department “K” of the FSB Economic Security Service Andrey Vasiliev was accused of especially large-scale fraud (part 4 of article 159 of the Criminal Code of the Russian Federation), committed together with the ex-head of this department Kirill Cherkalin and the retired deputy head of the department “K” by Dmitry Frolov.

Cherkalin in 2021 was sentenced to seven years in a strict regime colony with the deprivation of awards and military rank. The criminal prosecution of Andrey Vasiliev was terminated due to a ten-year statute of limitations for the crime imputed to him.
