Legislators Segundo Chimbo and Ricardo Vanegas, members of the Pachakutik caucus, made official on Sunday, February 13, a request for impeachment against the seven members of the Council for Citizen Participation and Social Control (CPCCS), for breach of duties in the appointment of authorities and for violation of regulations in the removal of a member of the Judicial Council.
The trial request has 38 supporting signatures and seeks the dismissal and censorship of the directors Sofía Almeida, David Rosero, Juan Dávalos, Ibeth Estupiñán, María Fernanda Rivadeneira, Francisco Bravo and Hernán Ulloa. Although the file also includes Pablo Ramiro Iglesias Paladines, superintendent of Territorial Planning, Land Use and Management.
In the Legislative Administration Council (CAL) there is a request for impeachment with 72 supporting signatures against CPCCS councilors Hernán Ulloa, María Fernanda Rivadeneira, Francisco Bravo and Ibeth Estupiñán. The report of the Legislative Technical Unit (UTL) is awaited for its qualification.

Vanegas said that there are differences with the political trial presented the previous week by another group of legislators from Pachakutik, UNES and the PSC, because that seeks to remove four councilors from the CPCCS, who today make up the new majority, for introducing changes in the regulation, when according to the Constitution and the Ecuadorian legal framework, drafting a regulation is within its powers.
On the other hand, this new political trial, added Vanegas, is not based on the elaboration or modification of regulations, but on acts that the plenary of the CPCCS has taken, which are verifiable and do not require a resolution by a judge, such as the removal of Fausto Murillo as a member of the Judiciary Council, since the only power that the Participation Council has is to appoint and not remove, explained Vanegas.
His co-ideator Segundo Chimbo revealed that they also requested information to certify whether the seven CPCCS counselors, in the pandemic, worked in person or virtually, that the collection of travel expenses and residence costs in the city of Quito is justified. Likewise, in recent days there has been much criticism against the Participation Council for the designation of the authorities of control bodies, which has not been transparent, and apparently “the functional bodies would have been distributed with their respective authorities” .

In the first cause, the censorship and dismissal of the directors Sofía Almeida, Juan Dávalos, Ibeth Estupiñán and María Fernanda Rivadeneira are requested, for ordering in the session of that body on April 23, 2021 the removal of the functions of member of the Council of the Judiciary to Fausto Murillo Fierro, because presumably the official at the time of his possession and during the exercise of his position registered a legal impediment to perform said function, and to do so they relied on a sent by Andrés Isch Pérez, at that time Minister of the Work, with which they violated the competences that they constitutionally have.

In the second case, the Pachakutik legislators request the censorship and dismissal of the directors Sofía Almeida, David Rosero, Juan Dávalos, Ibeth Estupiñán, María Fernanda Rivadeneira, Francisco Bravo and Hernán Ulloa, due to an alleged conflict of interest in the appointment of Pablo Iglesias Paladines as superintendent of Territorial Planning, Land Use and Management, for which they also propose his dismissal and censorship.
The file indicates that Pablo Iglesias was included in a short list sent by former president Lenín Moreno and that his sworn statement was insufficient, and that his resume shows that he was a consultant for the ACME company, presided over by Christian Cruz Larrea, which in March of 2021 was also president of the CPCCS, so he should not have been qualified, which produces a breach of duties for all those who participated in that qualification process.

In this accusation, the proponents request the dismissal and censorship of the councilors Sofía Almeida, David Rosero, Juan Dávalos and Ibeth Estupiñán, since there would be a conflict of interest in the appointment of César Córdova Valverde as the ombudsman in charge, made on September 18 of 2021.
The legislators point out that the general secretary of the CPCCS was appointed as the person in charge of the Ombudsman’s Office, with which their conduct would be adapted to an evident conflict of interest and breach of duties by the councilors.
With this, according to legislator Ricardo Vanegas, it is shown that the current Ombudsman was born from the Council for Citizen Participation and Social Control, and also CPCCS officials moved to work for the Ombudsman and there are proven cases, he said. (I)
