That the defendant has a red diffusion is one of the conditions for him to be included in the list of Interpol (International Criminal Police Organization) and to be wanted abroad.
“We are part of some international networks, such as Interpol, and we help each other. What we do is prepare the files, the reports of these people that we have located abroad and we pass them on. The important thing here is that they have red diffusion, so that international legal and administrative procedures are followed to proceed with the arrests,” says José Villacís Bonilla, head of the Unit for the Detention of Highly Dangerous Persons Required by Law, in charge of the program Los Most Wanted.
The judge or the competent judicial authority requests that the red notice be issued against a person required by justice for the purpose of search, location, capture and future extradition to Ecuador, he adds.
To enter these international lists, it is necessary for the person involved to have an executed sentence or detention ticket, even for investigation purposes, in order to guarantee his appearance at trial.
“We focus on highly dangerous fugitives who have to come to serve their sentences in the country,” says Villacís.
Interpol indicates that “red notices are issued on fugitives wanted for prosecution or to serve time”. The agency’s website states that it is “a request to law enforcement agencies around the world to locate and provisionally detain a person pending extradition, surrender or similar legal action.”
There are fourteen people of Ecuadorian nationality who have a red notice on the public list and are required by the United States, Argentina and Guatemala, according to information on the entity’s website.
There are currently 69,270 valid Red Notices, 7,500 of which are publicly accessible, according to Interpol’s website.
Among the Ecuadorians is Francisco M., 60, on trial for murder, possession of a weapon for an illicit purpose, aggravated arson, and robbery. In addition to a citizen who has Ecuadorian and Russian nationalities, prosecuted for money laundering.
The important thing, says Villacís, is to remove from anonymity all these people who commit crimes and break the law. “We want there to be no impunity or unsolved cases,” he says.
The payment of rewards in exchange for giving data that helps determine the whereabouts of the most wanted is regulated in Ecuador through a commission.
“The information has to be truthful, effective and timely. Verification is through a positive result on the place where the person you are looking for is located”, indicates Fernando Altamirano, professor at SEK International University.
Another of the conditions to enter the lists, such as that of gender violence, is that the accusation has to be in crimes of public action and not of private action, which are punctual, says Altamirano, such as slander, usurpation, rape, injuries, among others.
Those of public action are those that find the prosecutor as the holder of the criminal action, affirms Altamirano. These include gender violence, fraud, murder, usury, drug trafficking, among others. “All this wide range of crimes. Also when there is a real harmfulness with the evident affectation of the protected legal interest without just cause. There we distort the issue of legitimate defense, state of necessity or compliance with legal duty.
