In Esmeraldas, a man is sentenced to 19 years for raping a teenage mother

The assailant carried a firearm and a knife, and threatened the minor with killing her 11-month-old baby if she screamed or called for help.

Jhon Jairo EB was sentenced this Thursday to 19 years in prison for the rape of a 15-year-old girl. The incident occurred last year in the province of Esmeraldas.

A criminal court in Esmeraldas determined that on April 8, 2021, in the afternoon, the victim was washing dishes — along with her 11-month-old son — in the Nuevo Pedregal neighborhood, on the banks of the Nadadero River, in the canton San Lorenzo, when Jhon Jairo EB approached her with a revolver and a knife to subdue her and sexually assault her, threatening to kill her son if she screamed or asked for help.

The facts were reported and the attacker was arrested by the police.

During the trial hearing, the prosecutor José María Mosquera presented as evidence the victim’s anticipated testimony, the medical and psychological assessment report performed on the adolescent, among others, which determined the defendant’s responsibility in the imputed crime.

At the end of the procedure, judges Juan José Villamar, Joselito Estrada and Segundo Montaño also ordered the payment of $5,000 as comprehensive reparation to the victim and 600 unified basic salaries ($255,000) as a fine.

Jhon Jairo EB was prosecuted for the crime of rape, typified in article 171, numeral 2, of the Organic Comprehensive Criminal Code (COIP), which punishes this crime with a prison term of 19 to 22 years. (I)
