Sebastián Yunda and seven others prosecuted for illicit association will know on January 18 the accusatory opinion that the Prosecutor’s Office maintains

Since last December, an extradition process has been in force against Sebastián Yunda, which seeks to bring him from Buenos Aires, Argentina, where he was detained.

Days after the prosecutor Mónica Tirado notified the closure of the prosecutorial investigation stage against eight people accused of the crime of illicit association, among whom is Sebastián Yunda, son of the dismissed mayor of Quito Jorge Yunda, the criminal judge of Pichincha Máximo Ortega defines that next January 18, from 10:00, the evaluation hearing and preparatory trial are installed.

The summons is made to the eight defendants, so it is understood that there would not be an opinion abstentive on the part of the Prosecutor’s Office, but an accusatory opinion against all. The prosecution in this case lasted 120 days, in which the existence of a structure that supposedly had access to privileged information to benefit from money from contracts related to the Municipality of Quito was investigated.

In addition to Sebastián Yunda, in this case César Yunda, Sebastián’s uncle; Christian Hernandez, ex-adviser to Jorge Yunda; the former chief of staff of the then mayor of Quito, Cinthya Puga; Adrián Haro, former manager of the public company EMSeguridad; event organizer Pamela Novoa; businesswoman Nancy Gaibor and her husband, the former director of the Ecuadorian-China Chamber of Commerce Yinlong Wang.

Sebastián Yunda’s defense believes that there is political persecution against him; the National Court prepares the sending of the extradition request to Argentina

The defense of Sebastián Yunda, Édgar Molina, as well as other defenders of the accused, they assure that the 120 days of investigation are closed without the Prosecutor’s Office having obtained conclusive elements that confirm the accusation it makes. It was anticipated that at the hearing, they will make known to the criminal judge Máximo Ortega that there are several nullity vices that prevent the case from moving along the line that the Prosecutor’s Office intends.

The investigation stage is closed in the middle of an extradition process so that Jorge Yunda’s eldest son and leader of the musical band 4AM is brought to Ecuador from Buenos Aires, Argentina, place where he was detained on December 1 last by Interpol (International Police) agents, due to a red notification that fell on Sebastián.

Hernández, Puga, Haro, Novoa, Gaibor and Wang have complied with the precautionary measures of periodic presentation and prohibition of leaving the country throughout this time. Meanwhile, about César Yunda or the “uncle Cesario”, as he is located in several chats analyzed in the process, maintains a blue Interpol broadcast, a preventive detention order and its last location was Mexico.

This case of illicit association initially started by analyzing an organized crime crime in which the only suspect was Sebastián Yunda. 209 information sheets were sent to the Transparency Unit of the Prosecutor’s Office by the provincial prosecutor of Pichincha Alberto Santillán, on March 30, 2021, to start with the preliminary investigation.

This information corresponded to what was found through expert reports on the cell phones of the mayor of Quito and his son Sebastián, up to that point. This expertise was given within the tax instruction for the crime of embezzled for the purchase of 100,000 tests to detect Covid-19 made by the Ministry of Health of the Municipality of Quito and in which Jorge Yunda and thirteen other people hold a current trial hearing.

The red notice against Sebastián Yunda came after this defendant failed to comply with the precautionary measure of periodic presentation. Judge Ortega revoked the measure and ordered his imprisonment preventive, also asking Interpol to locate and capture the eldest son of the ex-mayor at an international level.

There is still no response from Argentina to the extradition request made by the National Court of Justice, but while what will happen is elucidated, Sebastián Yunda is free, but complying with various provisions of the Argentine justice, such as the periodic presentation or the prohibition of leave that country.
