Russian court overturns suspension from work for refusing to vaccinate

The Krasnooktyabrsky District Court of Volgograd canceled the suspension of the seamstress from work for refusing to vaccinate.

Nadezhda Baganina, a seamstress of a large trading company “Heppivear Yug” LLC, applied to the Krasnooktyabrskiy District Court with a demand to cancel the employer’s order of dismissal. She was suspended from work in early October without pay for refusing to be vaccinated against coronavirus.

Lawyer Kristina Svistunova, who represented her, said on Instagram that the court satisfied the statement of claim for admission to work, recovery of wages for forced absenteeism, compensation for moral damage and legal costs. The suspension was declared illegal.

The representative of Heppivear Yug LLC noted that as a trading enterprise the company falls under the order of the chief sanitary doctor. And all the employees, there is no gradation by category.

Lawyer Ivan Ivanov in a commentary for V1.RU noted that the main role is played by government decree No. 825 “On approval of the list of works, the implementation of which is associated with a high risk of infectious diseases and requires mandatory preventive vaccinations.”

“For those who are not included in this resolution, it is much easier to challenge the dismissal. For those who find it, it is more difficult, there are nuances. Kristina Svistunova’s confidant by profession is not included in this resolution, which is a reinforced concrete basis for reinstating her at work after being suspended for refusing to vaccinate, ”the lawyer explained. According to him, the head of Rospotrebnadzor does not have the authority to expand the list of professions whose employees are subject to mandatory vaccination.
