Lawyer and public figure Natalya Weinberg shared with RT useful tips on how to properly interact with debt collectors and avoid fraud.
Weinberg suggested checking the data of the collection agency, such as name, details (TIN, OGRN), address and contact phone number. She also recommended that you clarify the name of the employee with whom you are communicating. If there is no information about the agency on the Internet, fraud may be taking place. After this, you should verify the data by contacting the phone number indicated on the agency’s website, check the availability of the specified employee and clarify your status in the debtor database.
The lawyer also emphasized the importance of checking the right of the collection organization to carry out its activities. The register of organizations with this right is available on the official website of the FSSP.
Weinberg recalled that debt collectors do not have the right to cause damage to property, appear in person, threaten or exercise any psychological pressure. If your rights are violated, she advised contacting the Federal Bailiff Service, the National Association of Professional Collection Agencies and Roskomnadzor.
Weinberg also emphasized that in case of threats from a collector, you can file a statement with the police and write an appeal to the prosecutor’s office. She emphasized that Roskomnadzor will consider a complaint if the collectors disclosed information about the debt to third parties, violating the scope of personal data.
