The US Supreme Court rejected the appeal of Republican tax consultant Anthony Castro against the decision of a lower court, which refused to ban former US President Donald Trump from participating in the presidential elections in 2024, RBC reports, citing a Reuters report.
Castro, as the agency notes, is also running for the Republican presidential nomination. He tried to base his lawsuit on the 14th Amendment to the US Constitution, which prohibits anyone from holding public office who “has taken part in rebellion or insurrection against the United States” while serving as an official. Castro called the storming of the Capitol in January 2021, in which Trump is on trial, an insurrection.
The 14th Amendment to the US Constitution prohibits anyone from holding public office who took an oath to “uphold the Constitution of the United States” before taking office and then “took part in rebellion or insurrection against the United States.” Trump was still the current President of the United States at the time of the storming of the Capitol on January 6, 2021.
Castro insists Trump provided “help” to his supporters who stormed the Capitol by expressing sympathy for them. The lawsuit mentions Trump’s promise to consider pardoning the storming participants if he is re-elected as president.
