Democracy is failing. Not only here, but in almost the entire Western world, democracy is criticized, accusing it of not being a form of government for today; But the critics, as is often the case, do not propose a better form of government that will realize the people’s desires for justice and peace.

I believe that the problem is not in the form of government, but in those who hold various public functions. All three provide the necessary balance to avoid abuses by authority, and according to Montesquieu’s well-known conception, their proper functioning is essential.

The importance of a state with three separate powers

We have to talk about the judicial function. If judges are venal and allow themselves to be bought, they do not dispense justice, but favor those who pay them. The current Constitution gave birth to two predatory fetuses: the so-called Council for Citizen Participation and Social Control, which is easily managed and has the power to appoint control bodies, and the Judicial Council, which appoints and supervises the administrators of justice. Both organizations were inefficient and poorly managed. Theatrical gestures that imitate Mussolini, vigils that throw stones and hide their hands. It is bad luck for Ecuador to have a subject who exchanged priestly habits for the garb of a criminal as president of one, and now of another who cunningly dares to oppose the Constitutional Court to review the actions of the Council presided over by Julio César Trujillo, a judge of integrity and honest ability. If we start to question the decisions that have already created the state, justice disappears, and thus trust in the institutions of democracy, because legal certainty, the foundation on which the legal state is built, is under attack.

Would you, patient reader, risk your money in a country where the judgments of judges can be reviewed and changed after decades at the risk of harming your interests? If in that country, which is ours, someone in power hides behind the right to seek public scrutiny in order to realize his aspirations and exacerbate the tensions that life creates, it means that impunity is allowed for conspirators of all colors. What does the Court say?

Ecuador is resisting

We cannot tolerate that the insecurity of citizens on the streets due to the crackdown on criminal groups is added to the reasons of non-obligation and distrust in democracy. It is necessary to reform the Constitution, which gave birth to monstrosities. Also criminal laws with their bias to protect criminals more than citizens. Limit the powers of multijurisdictional judges to grant protection to those convicted of crimes. We live with the uncertainty of falling into the networks of “vaccinators” or in the crossfire of the police and criminals.

It seems good to me that President Guillermo Lasso strengthened the weapons of the public forces so that they can better defend the poor and ordinary citizens, workers and investors. We all have to do our part. It is necessary to repeat the message that Admiral Nelson placed on the flags of the victorious English fleet at Trafalgar: “I hope that each will do his duty.” (OR)
