A policeman and a guard are prosecuted for the alleged crime of rape in the Judicial Council building

A 21-year-old woman went to the Judicial Council to pay money she owed to Jefferson F., who was on guard duty on the night of November 21. She was taken to a space that functioned as a warehouse, where Police Corporal Néstor F. was there, with whom she would have been consuming liquor.

This is stated in the version rendered before the Prosecutor’s Office, which details that the policeman was left alone with the woman and during the early morning she would have been a victim of rape.

The victim yelled for help, but Jefferson F., who was outside the warehouse, did nothing to stop the crime, according to the complaint.

“According to what was exposed by the prosecutor Nadia Proaño at the hearing, the aggrieved young woman tried to get away from the scene aboard a taxi, but the defendants prevented her from leaving, paying the taxi driver three dollars. She was forced to return to the Judicial Council building, while she cried out for help, ”the Prosecutor’s Office said in a statement.

Given this, police officers arrived at the scene and apprehended the two suspects in the rape. They were transferred to the Flagrancy Unit where the hearing took place.

Despite the fact that the prosecutor presented the gynecological examination carried out on the victim, a complaint against those involved, a preliminary interview, the version of the arresting agent, the technical eye inspection report and the compilation of 14 pieces of evidence, the judge denied the request for preventive detention against the defendants.

What he dictated were alternative measures, they will be prohibited from leaving the country, periodic presentation and the use of the electronic shackle.

In addition, the judge accepted the request for protection measures in favor of the victim. It was decided to “prohibit the accused person from approaching the victim, witnesses and certain people, in any place where they are (…) order the respective treatment to which the accused person or the victim and their children under the age of 18 years, if that is the case”.

Article 171, first paragraph, of the Comprehensive Organic Criminal Code (COIP) establishes: “Carnal access is a violation, with total or partial introduction of the virile member, orally, anally or vaginally (…) Whoever commits it will be punished with a custodial sentence of nineteen to twenty-two years.”
