After an extraordinary session held on Wednesday afternoon, the five councilors of the municipality of the May 24 canton approved a report from the table commission that recommended the removal of Duval Valeriano Ponce, mayor of this city of Manabi.
According to the report prepared by the table commission, Valeriano would have incurred some non-observance of the Organic Code of Territorial Organization, Autonomy and Decentralization of Ecuador (Cootad), as reported by the municipal secretary Héctor Plúa Pin, during the session.
The motion for the recommendation of dismissal was made by councilor Alberto Pin, which was supported by his four fellow councilors: Katherine Constante Pacheco, José Huerta, María Toala and Stalin Zambrano, current deputy mayor of the town.
Among the alleged irregularities and non-observances that Valeriano would have incurred, which were collected by the committee created to analyze the issue, there are alleged administrative anomalies related to the parliamentary procedure regarding the election of the vice mayor of this canton; calls to ordinary sessions; in the number established in article 318 of the Cootad, presentation to the municipal council of the reform to the extended budget for the fiscal year 2019; presentation to the council of the monitoring and evaluation report of the semi-annual execution of fiscal year 2019, it was indicated.
According to the report, it is also argued that the municipal council was allegedly not made aware of the budget settlement for the fiscal year 2019 and the presentation to the council of the final draft of the budget for fiscal year 2021.
For his part, Vinicio Tapia, Valeriano’s defense attorney, in his speech pointed out that this process is invalid, mainly because – according to him – the municipal secretary is an official who was dismissed.
For his part, Zambrano pointed out that they will issue this report to the Contentious Electoral Tribunal, a body that must decide whether or not the decision of the municipal council of the May 24 canton to remove its mayor is validated less than 17 months after the end of his administration, in May 2023.
