Last week, the President of the Republic, Guillermo Lasso, signed decrees 264 and 265 in order to reduce overcrowding in the country’s prison complexes and urged the Ombudsman to facilitate their patronage to those deprived of liberty who need this pardon.
Decree 265 specifies that forgiveness of the sentence will be granted to those suffering from catastrophic illnesses, terminal illnesses, multidrug-resistant tuberculosis and TB-HIV co-infection. Meanwhile, Decree 264 includes those convicted of traffic offenses provided for in articles 383 or 386 of the Comprehensive Organic Criminal Code (COIP), which does not involve death or injury.
In order to receive the forgiveness of the sentence, the person deprived of liberty must meet the following requirements: have an enforceable conviction for one of the aforementioned offenses and have no pending criminal proceedings against them.
Procedure
The National Service for Comprehensive Attention to Adults Deprived of Liberty and Adolescent Offenders (SNAI) is in charge of verifying the identity of PPLs that meet the requirements stipulated in the two decrees.
Once these aspects have been verified, the SNAI sends a report to the competent judicial authority, in order to proceed with the release of the inmate.
In the case of PPL with diseases provided for in Decree 265, the Ministry of Health will provide the necessary information and support to the SNAI. (I)
