In Russia, the case against the debtor was first opened by a robot

The robot program without the participation of a bailiff for the first time in Russia initiated enforcement proceedings against a debtor in Ryazan. According to the Federal Bailiffs Service, work has begun in the Russian Federation on the implementation of a law that allows automatic procedural documents to be issued in those cases “where unconditional adoption of such decisions is possible.”

The department added that in this way they will be able to optimize and speed up the processes within the framework of the enforcement of court decisions.

It should be noted that in 2022 a bill was adopted, according to which the initiation of enforcement proceedings without the participation of a person is possible in cases where a decision can be made only on the basis of data from the system. In automatic mode, it is now possible to collect a performance fee from debtors and establish or cancel restrictions imposed on the debtor, including arresting property, as well as providing acts of deferment.

As David Kononov, head of the practice at Lemchik, Krupsky and Partners, told Kommersant, robots will help the bailiff service collect more debts, however, this format of work still carries certain risks for citizens. As an example, he named cases when enforcement proceedings were initiated against namesakes and even full namesakes. In this case, the key issue is the consequences, because the initiation of enforcement proceedings in itself does not imply any negative things.

However, further arrests are imposed, prohibitions on the free use of funds. A ban on traveling abroad may appear, and a person who has nothing to do with this may fall under this algorithm.
