The State Duma adopted in the second reading a bill on the confiscation of money and property obtained as a result of cybercrime. It is reported by TASS.

The document was submitted to the chamber on November 18, 2022 by a group of parliamentarians headed by Vasily Piskarev, chairman of the Duma Committee on Security and Anti-Corruption, and Andrey Klishas, ​​head of the Federation Council committee on constitutional legislation and state building. The first reading of the bill took place on 9 February.

Changes are made to Art. 104.1 (confiscation of property) of the Criminal Code of the Russian Federation. In the original version of the bill, it was proposed to introduce confiscation of money, valuables and other property when committing crimes under Art. 272 (illegal access to computer information), art. 273 (creation, use and distribution of malicious computer programs), art. 274 (violation of the rules for the operation of means of storage, processing or transmission of computer information) and art. 274.1 (illegal impact on the critical information infrastructure of the Russian Federation).

By amendments to the second reading, the parliamentarians clarified that under Art. 272 of the Criminal Code of the Russian Federation, confiscation will be threatened only if the crime caused major damage or was committed out of selfish interest, committed by a group of persons by prior agreement, by an organized group or by a person using his official position, and also if the crime caused serious consequences or created a threat of their occurrence .
