AFP: they want funds not claimed by heirs to be transferred to the State

Congressman Alejandro Soto Reyes, from the Alianza para el Progreso bench, proposes that the funds managed by the AFPs that have not been withdrawn by the heirs of deceased contributors be transferred to the public treasury, by amending article 12 of the Political Constitution From Peru. It should be noted that in July 2022 a project was presented, by Acción Popular, with a similar objective that is still in the Economy Commission today.

In this way, PL 4800, presented on April 26, 2023, indicates that there is the possibility that the member of an AFP opts for the programmed withdrawal of his money; however, this remains in their individual capitalization account when the contributor dies and, in turn, has no heirs.

It is also specified that the constitution states that these funds are of an intangible nature and cannot be seized, “however, It is also true that these funds cannot remain in the hands of the AFPs.; For this reason, this proposal proposes that in the event of the contributor’s death, the balance must go to the
National Treasure,” the document states.

The Superintendency of Banking and Insurance reported that by 2022 there were some 24,464 deceased affiliates whose direct relatives do not claim a survivor’s pension (spouse, children under 18 years of age or parents). Thus, he estimated that the funds of these affiliates add up to a total of S/345 million.

The initiative must go through the evaluation of the congressional commissions before reaching the plenary session for debate and voting.
