Cell phones of Jorge Yunda and Sebastián Yunda will be appraised within the process for illicit association

Sebastián Yunda, son of the removed mayor of Quito, Jorge Yunda, is one of the eight prosecuted by the Prosecutor’s Office for the crime of illicit association.

In a private hearing that could take place this week, the judge who takes the case for the crime of illicit association in which he is prosecuted Sebastián Yunda and seven other people authorized the fixation, opening, exploitation, extraction, analysis, materialization, preservation and transcription of the content of two cell phones that would belong to the former mayor of Quito Jorge Yunda and his son Sebastián.

Judge Máximo Ortega gave way on November 11 to the request made by the Prosecutor’s Office for the information to be assessed contained in two chains of custody, which would include Jorge and Sebastián Yunda’s cell phones. The request was made on November 9 last, because for the Prosecutor’s Office it is important to have the expert information of these two devices within this criminal process.

This case in which illicit association is being investigated today began by analyzing an organized crime crime in which the only The suspect was Sebastián Yunda. 209 information sheets were sent to the Transparency Unit of the Prosecutor’s Office by the provincial prosecutor of Pichincha, Alberto Santillán, on March 30, to start with the preliminary investigation.

This information corresponded to what was found in the expert cell phones of the two Yunda, within the fiscal instruction for the crime of embezzlement for the purchase of 100,000 tests to detect COVID-19 made by the Secretary of Health of the Municipality of Quito. In it, the removed mayor and thirteen other people hold a current trial hearing.

Currently on Sebastián Yunda there is a red diffusion of Interpol (International Police, for its acronym in English), because by breaching the precautionary measure of periodic presentation, the judge revoked it, ordering his preventive detention and asking Interpol to locate and capture at the international level the eldest son of former mayor Yunda. Bolivia was the last place Sebastián Yunda would have been.

At the beginning of last September, the information located on Sebastián’s cell phone led to 19 raids in Quito and Guayaquil, for which Christian Hernández, Jorge Yunda’s former adviser; Cinthya Puga, already at that time, former chief of staff for Mayor Yunda; Adrian Haro, manager of the metropolitan public company EMSeguridad; Pamela Novoa, Nancy Gaybor and her husband, the Chinese-Ecuadorian businessman Yinlong Wang.

Once these six people were initiated a tax instruction for 90 days for the crime of illicit association, days later was linked to the case Sebastián Yunda and his uncle César Yunda. On the latter, who was located in Mexico, weighs an order of preventive detention and a blue broadcast from Interpol.

An additional 30 days were added to the investigation stage, that is, a total of 120 days for the Prosecutor’s Office to collect elements that support the theory that in this case all the defendants are part of the illicit association under investigation and which would be related, among other issues, with the negotiation of security cameras and —for the moment— of money from contracts made based on irregularities.

Within the version given by the defendant Christian Hernández, he said that he learned of the chats, which supposedly relate him, through the media and at the hearing to formulate charges for the crime of illicit association. According to Hernández, these chats were disclosed six months before his arrest. and the beginning of this criminal prosecution and, he pointed out to the Prosecutor’s Office, that since he was not certain of their “authenticity, veracity, context and content” of them, he could not refer to those chats.
