Persons with a criminal record can no longer work as taxi and public transport drivers. The relevant amendments to the Labor Code of the Russian Federation came into force on March 1.
According to these changes, a ban on driving when transporting passengers and luggage is established for drivers with an unexpunged or outstanding conviction for certain crimes. At the same time, the restrictions apply not only to convicts, but also to those against whom the case is being investigated under articles on murder, intentional infliction of grievous bodily harm, robbery or robbery, crimes against sexual integrity, crimes against public safety, the foundations of the constitutional order and state security.
Also, according to the new edition of the Labor Code, drivers who have been convicted or prosecuted for grave and especially grave crimes against public safety, the foundations of the constitutional order and state security will not be able to drive buses, trams, trolleybuses and rolling stock of off-street transport.
In addition, the ban also applies to those who are tried or prosecuted under similar articles of the legislation of other countries of the Eurasian Economic Union (which includes Russia, Armenia, Belarus, Kazakhstan and Kyrgyzstan).
Employers must enforce the law by requiring a certificate of no criminal record or harassment when hiring a new employee. Staff members must obtain a certificate of no criminal record or prosecution by September 1, 2023 or face termination. If the employer receives information from law enforcement agencies that the driver is among the suspects for the above crimes, he will have to suspend the employee from work for the entire period of criminal proceedings.
