The State will pay for the repatriation of the mortal remains of Ecuadorians who died abroad as long as the relatives demonstrate a situation of economic vulnerability and the lack of sufficient resources to carry out the process.
This was determined by the National Assembly this January 31, by accepting the observations made by the Executive to the project that reforms the Organic Law of Human Mobility. For the search motion, 129 legislators voted.
Through the regulations, which must be issued by the Ministry of Foreign Affairs and Human Mobility, repatriation will be regulated with a focus on human rights, and the preparation of the socioeconomic technical report and the vulnerability sheet will be the responsibility of the Qualification Commission that will be formed at consular offices.

The report issued by the Qualification Commission must consider factors such as family environment, social environment, economic situation, migratory situation and territorial location.
According to the reforms that will be published in the Official Gazette, the Repatriation Request Qualification Commission may not take more than fifteen working days to decide whether to accept or deny the repatriation request. If the report is not issued within the established period, it will be understood that the request has been approved.
The delivery of the mortal remains in Ecuador may not exceed the term of thirty days counted from the day of receipt of the respective request, except in cases in which the regulations or administrative or judicial processes of the country in which the person died Ecuadorian impede compliance with the aforementioned term.
The only exception to the deadlines are those cases prosecuted abroad that prevent the repatriation of mortal remains.
When the repatriation request is accepted, the Ministry of Foreign Affairs and Human Mobility will proceed with the embalming or cremation procedure, as appropriate.
If the Qualification Commission denies the request for repatriation, it may be challenged through all the effective remedies prescribed in the legal system.
These amendments to the Mobility Law will be published in the Official Gazette for them to enter into force. (YO)
