Since the end of last September Jorge Yunda, who is also criminally prosecuted for the crime of embezzlement, ceased to be the mayor of Quito.
Despite the fact that the Prosecutor’s Office requested preventive detention for the crime of influence peddling for former judge María Belén Domínguez, who resolved a protection action presented by the then mayor Jorge Yunda, the president of the Pichincha Court of Justice, Vladimir Jhaya, decided to order the weekly periodic presentation, the prohibition of leaving the country, the use of the electronic shackle, the prohibition to alienate goods and retention of accounts of the now processed.
The fiscal instruction in this criminal process will last 90 days. The periodic presentation of the former judge must be given every Monday at the Pichincha Court of Justice.
On September 14, the provincial prosecutor of Pichincha, Alberto Santillán, asked the Provincial Court of Justice for a hearing and it was, on Tuesday afternoon, who filed charges against Domínguez for alleged trafficking of influences occurred in the drawing of causes to resolve a guarantee Constitutional law filed last June, in the Judicial Complex of Quitumbe, in the south of Quito, by the now dismissed mayor Yunda.
On July 9, agents of the Public Prosecutor’s Office and the Police raided the office of Domínguez, and other judicial officials, as part of the investigations of this case.
Domínguez, who was a judge for Violence against Children and the Family of Quitumbe, attended the protection action filed Jorge Yunda against the councilors who made up the Table Commission which issued the reports for the removal of the mayor’s office. On June 28, the magistrate partially accepted the action to protect the appeal filed by Yunda, on the grounds that legal security was violated.
After the sentence, several citizen complaints arose about alleged inconsistencies in the drawing of the case that fell on Domínguez, as well as in the process of another protection action in which Judge Carlos Soto also agreed with Jorge Yunda and stopped his removal from the mayor’s office.

It was because of these remarks that on July 8 last the president of the Council of the Judiciary (CJ), María del Carmen Maldonado, announced the suspension of the then judges Domínguez y Soto, and other officials judicial. That same day, disciplinary proceedings of an administrative nature were initiated and the complaint was presented to the Prosecutor’s Office.
The member of the CJ Juan José Morillo said at that time that the case presented in Quitumbe was entered for an issue of violence, when in reality it was a constitutional protection action. At the beginning of last October, the plenary session of the CJ dismissed a Maria Belén Domínguez and Daniela A., judicial assistant of the Fifth Specialized Judicial Unit for Violence against Women of Quitumbe.
“Both officials were sanctioned for the established offense in numeral 13 of article 109 of the Organic Code of the Judicial Function and were investigated for their participation in the raffle of the constitutional protection action filed by Jorge Yunda (former mayor of Quito) ”, indicated the CJ at the time.
The argument for the dismissal is that, according to the CJ, irregularities were verified committed by both persons, for which their dismissal was recommended. (I)
